Litigation Relating to the Electric Zoo’s 2023 Festival Appear to be Consolidating Into a Larger, Single Class Action Lawsuit

After raverade reported that lawsuits relating to the Electric Zoo’s 2023 festival seek a combined total of more than $100 million, it appears the numerous lawsuits are in the process of consolidating into a larger, single class action lawsuit. Paraphrasing court paperwork from November 8th: “the complaints describe the same or substantially similar underlying events arising out of the same or substantially similar operative facts… the Clerk of the Court is respectfully directed to consolidate these actions.” You can access this information here, or see below:

There’s still no new information relating to refunds for the Electric Zoo’s Day 1 cancelation, or for the thousands of fans denied access after the event reached capacity on Sunday September 3. First reported by Gothamist, and according to the NYPD, some 7,000 ticket holders were denied entry that day. Organizers did release a brief statement in response to questions from Gothamist last month, telling affected ticket buyers that:

Electric Zoo will be issuing refunds to impacted ticket buyers and details will be communicated to them directly,

This is the first official correspondence form Avant Gardner relating to the 2023 festival since the end of September, where they made a similar statement at the time, stating that they were “not prepared to offer specifics on the refund process at this time.” Three months later, organizers are still unprepared to offer specifics.
