Electric Zoo Festival Organizers Face Consolidated Class Action Lawsuit & Thousands of Frustrated Attendees

The numerous lawsuits pertaining to the Electric Zoo festival's 2023 edition, "Hyperspace," have formally consolidated into a single class action lawsuit, suggesting that Avant Gardner, the festival organizers, are facing some significant legal issues that are only now beginning to flare up. This marks one of the first significant milestones for the case, which was filed in early September and was quickly followed by a spring of additional litigation against Avant Gardner on behalf of “thousands” of affected ticket buyers.

The new version of the now consolidated lawsuit makes many accusations against the festival organizers, - the most notable of which include:

  • Security soliciting bribes to allow entry into VIP areas

  • Deceptive acts and practices

  • Breach of contract

  • Unjust enrichment

  • Fraud

  • Negligent misrepresentation

Among many other other accusations. The suit goes on to outline what it refers to as a “history of of dangerous operation” on part of the festival organizers, who are infamous for overselling shows at their home venue, the Brooklyn Mirage. Plaintiffs seek an estimated minimum total of $47 million in damages, in addition to attorney and court fees incurred.

The festival’s failures resulted from and were exacerbated by defendants [Avant Gardner’s] consistent lies to attendees.
— Consolidated Class Action Suit

The Electric Zoo festival was purchased in July of 2022 for just $15 million. The fate of the festivals future is still unknown, especially considering regular fans are used to purchasing tickets during the festivals annual Black Friday sale, which did not occur this year. It’s also unknown if the festival intends to hold a 2024 edition. You can access the full version of the consolidated lawsuit here.
